Is Afamelanotide legal?

What that status actually means.

Afamelanotide has been reviewed by the FDA and approved for at least one specific indication. That approval is the strongest regulatory position any compound on this site holds, and it means a manufacturer submitted trial data on safety and efficacy that the agency evaluated and accepted.

Approval is always narrower than it sounds. It covers a specific indication, in a specific population, at labelled dosing, in a specific formulation. Using an approved drug outside that scope is off-label use, which is legal for a physician to prescribe and is not the same as the use being evidenced. The trial data supports the approved indication, not every use the molecule gets put to.

Approval also attaches to the product, not to the molecule in general. A compounded preparation of the same active ingredient is not the approved product, is not manufactured to the same standard, and does not inherit the clinical evidence behind the brand.

The regulatory record for Afamelanotide.

The FDA approved Scenesse (afamelanotide) in October 2019 to increase pain-free light exposure in adults with a history of phototoxic reactions from erythropoietic protoporphyria, with Orphan Drug and Priority Review designations; the European Medicines Agency had authorized it earlier (2014). It is a prescription implant administered by a trained physician. Melanotan-branded tanning products are not approved and are considered unapproved drugs in many jurisdictions.

Compounding, sport, and jurisdiction.

Three separate regimes govern a compound like this one, and they move independently. US compounding eligibility runs through sections 503A and 503B and the FDA lists that sit under them, which are revised over time as the agency evaluates individual substances. A compound can be widely compounded one year and removed from eligibility the next.

Anti-doping status is set separately by WADA and does not track FDA approval at all. The prohibited list covers peptide hormones, growth factors, related substances and mimetics as categories, which means an unapproved research compound can be firmly prohibited in competition while an approved medicine is permitted with the right documentation.

And none of this is global. Approval, scheduling and import rules differ by country, and a compound registered as a medicine in one jurisdiction can be entirely unapproved in another. Several compounds on this site are prescription medicines in one country and research chemicals in the next.
